TERMS & CONDITIONS

1. PARTICIPATION
  • You agree to participate in the “GrabFinance Smartphone Promotion” (the “Offer”), provided by GFin Services (M) Sdn Bhd (“the “Company”). This offer is subject to you remaining as an active Grab Driver-Partner on the Grab platform and fulfilling any other eligibility conditions determined by the Company from time to time. Notwithstanding this, the Company reserves the right to reject any participation from any Grab Driver-Partner at its sole and absolute discretion without assigning any reason whatsoever.
  • By participating in this Offer, you agree that you have read and understood the terms in these Terms & Conditions and agree that these Terms & Conditions constitute a legally binding agreement between you and the Company.
  • Notwithstanding the above, these Terms & Conditions shall be read together with any other conditions issued by the Company or any other subsidiary, affiliate or associated company of Grabtaxi Holdings Pte. Ltd. (collectively, “Grab”) which are applicable to you.
  • By participating in this Offer, you shall select the intended Samsung Mobile Phone of your choice and agree to the payment terms which are set by the Company over a period of 182 days. Selected Driver-Partner will receive a notification which contains unique voucher code via SMS from the Company only when the application is successful. The unique voucher code is only to be used for the purchase of smartphones from our Partner Website available at www.myviporder.com/grab. By participating in this Offer, you are not to modify or ‘root’ and download any applications that are illegal or not approved by the application store that will interfere with the safety and security of the smartphone.
2. VOUCHERS
  • By participating in this Offer, you will receive a unique voucher code worth up to RM2,299* (“Voucher”) in total issued by One World Marketing Sdn Bhd (“Partner”), to be used at https://myviporder.com/grab/ and you agree to the repayment terms via deductions as stipulated in Application Form over a period of 182 days (6 months).
  • You may use the Voucher to purchase a Samsung smartphone up to maximum cost not exceeding the Voucher amount you received. You may choose to spend less or more than the Voucher amount, however if your purchase is above the Voucher amount, you will be required to pay the balance outstanding amount via debit/credit card on the website.

Please further note that:

  • The Voucher is not valid after the expiry date stated on the Voucher, which will be communicated via in-App or SMS.
  • The Voucher is only valid for purchase of a Samsung smartphone on the website https://myviporder.com/grab/ and is not exchangeable for cash.
  • The Voucher is not valid for physical purchase at the Partner’s store. *The amount of Voucher  will differ based on individual Driver-Partner’s eligibility and will be communicated upon approval.
3. SELECTION OF PRODUCTS
  • By participating in this Offer, you also agree that you have read and understood and agree to the terms and conditions issued by Partner which may be amended from time to time without notice to you. Each Driver-Partner is allowed to purchase one (1) unit of the product at any one time. All product pictures are for illustration purposes only and may differ from actual products. All items and colours are subject to availability. Offer is based on a first come first served basis and while stocks last basis. The Voucher code must be entered in order for you to avail the Daily Repayment method (as further described below) under this Offer. Smartphones order will be checked and approved by the Company and Partner will proceed accordingly based on approval of the Company.
4. DRIVER-PARTNER’S RESPONSIBILITIES
  • By participating and subscribing to this Offer, you agree that you shall be responsible and liable for the Daily Repayment (as defined below) applicable to this Offer. You hereby acknowledge receipt of the notice of assignment that the receivables of the debt created by your purchase of the smartphone shall be assigned by the Partner to the Company. For the avoidance of doubt, Partner shall remain fully liable to perform all their obligations under the sales invoice and under the consumer protection laws, and the Company is under no liability whatsoever in the event of Partner’s failure to perform their obligations thereunder.
5. DAILY DEDUCTION
  • Based on the final purchase amount of the smartphone you have chosen, you are required to repay in 182 equal instalments on a daily basis (“Daily Repayment”).
  • Daily Repayment shall be made via deductions from the Driver-Partner’s cash and/or credit wallet every day for 182 consecutive days from the date that will be notified to you by the Company  (SMS or in-App message) until full payment of the total invoice has been collected. If funds in the cash and/or credit wallets are insufficient, multiple deduction attempts shall be made daily until the full outstanding amount is received.

This daily deduction schedule follows the same pattern and continues for the next 181 days (total of 6 months) after the first daily deduction is made
  • All payments shall be made in Ringgit Malaysia (RM). No additional charges or fees will be imposed by the Company.
6. SHIPPING
  • The Partner will distribute the smartphone purchased under this Offer through courier delivery service method to your address. The smartphone will be shipped 7 working days after the order is approved by the Company. Delivery address must be within Malaysia. Please note that there is a flat rate shipping fee of RM20 which will be charged and is NOT included in the Voucher amount. This would apply even if the value of the smartphone purchased is less than the Voucher amount.

7. CANCELLATION POLICY
  • You are not allowed to cancel, revoke or withdraw your participation in this Offer once you have received notification from us that your application is successful.
8. WARRANTY
  • All Samsung products are 100% genuine and original from Samsung.
  • All new Samsung products come with a 1- year limited warranty against manufacturing defects and materials.
  • Please visit the selected Samsung Service Centre for any manufacturing defects.
  • Please take note that the accessories under Purchase with Purchase (PWP) and free gifts are generic products, not covered under the warranty.
9. PERSONAL DATA
  • By participating in this Offer, you agree that any information which you have submitted to the Company may include your personal data and you hereby give consent for the Company and Grab to process your personal data in accordance with Grab’s privacy policy: www.grab.com/privacy) and applicable data protection laws. Any personal data submitted to Partner via https://myviporder.com/grab shall be governed by the privacy policy available on that website: http://myviporder.com/grab/privacy-policy/.
10. MISCELLANEOUS
  • The Grab Driver-Partner Terms of Use shall apply to these Terms and Conditions.
  • The Company reserves the right to vary any of these Terms and Conditions at any time. Such amendments shall be effective once they are notified to you.
  • The Company shall not be liable for any claim by you or third-party claims or losses of any nature, including but not limited to, loss of profits, punitive, indirect, special, incidental, or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with this Offer.
  • The Company disclaims any liability for loss or damage to property or any personal injury or loss of life resulting from or in connection with this Offer.
  • The Company reserves the right, at its absolute discretion, to use the names, photographs, voice or video recordings and entries of the Driver-Partner for publicity, advertising, trade or Grab Exclusive Program purposes in any media, without first obtaining any consent nor making any payment whatsoever to the Driver-Partner.
  • You acknowledge and agree that the Company reserves the right to disqualify any participation or terminate the service under this Offer if the Driver-Partner is in breach of any provision of these Terms and Conditions which is incapable of remedy or if capable of remedy, is not remedied within 3 days of receipt of notice by the Company. Notwithstanding the above, the Company reserves the right to terminate any participation on the Driver-Partner under this Offer, with notice to the Driver-Partner, at the Company’s its sole and absolute discretion without assigning any reason whatsoever.
  • On termination by the Company, the entire outstanding balance owed by you under these Terms and Conditions shall become due and payable in full to the Company.

TERMA & SYARAT

1. PENYERTAAN
  • Anda bersetuju untuk menyertai “Promosi Telefon Pintar GrabFinance” (“Tawaran”), yang disediakan oleh GFin Services (M) Sdn Bhd (“Syarikat”). Tawaran ini adalah tertakluk kepada Rakan Pemandu Grab yang aktif di platform Grab dan memenuhi syarat kelayakan lain yang ditentukan oleh Syarikat dari semasa ke semasa. Walaupun bagaimanapun, Syarikat berhak untuk menolak penyertaan mana-mana Rakan Pemandu Grab mengikut budi bicara mutlaknya tanpa perlu memberikan apa-apa alasan.
  • Dengan menyertai Tawaran ini, anda bersetuju bahawa anda telah membaca dan memahami Terma & Syarat dan bersetuju bahawa Terma & Syarat ini merupakan perjanjian yang mengikat secara sah antara anda dan Syarikat.
  • Walau apa pun perkara di atas, Terma & Syarat ini hendaklah dibaca bersama dengan syarat-syarat lain yang dikeluarkan oleh Syarikat atau anak syarikat, syarikat gabungan atau syarikat bersekutu Grabtaxi Holdings Pte. Ltd. (secara kolektifnya, “Grab”) yang berkenaan dengan anda.
  • Dengan menyertai tawaran ini, anda perlu memilih Telefon Pintar Samsung pilihan anda dan bersetuju dengan syarat pembayaran selama 182 hari yang ditetapkan oleh Syarikat. Kod baucar unik akan diberikan melalui SMS kepada Rakan Pemandu yang terpilih setelah permohonan diluluskan. Kod baucar unik ini juga hanyalah sah digunakan untuk pembelian telefon pintar di laman web Rakan-Kongsi kami di www.myviporder.com/grab. Dengan menyertai Tawaran ini, anda tidak boleh mengubah atau ‘root’ dan memuat turun aplikasi yang tidak sah atau tidak terdapat dalam Play Store yang akan mengganggu keselamatan telefon pintar.
2. BAUCAR
  • Dengan menyertai Tawaran ini, anda akan menerima baucar kod unik bernilai sehingga RM2,299* (“Baucar”) yang dikeluarkan oleh One World Marketing Sdn Bhd (“Rakan-Kongsi”) untuk digunakan di laman web https://myviporder.com/grab/ dan anda bersetuju dengan terma pembayaran balik melalui pemotongan selama 182 hari (6 bulan) seperti yang dinyatakan di dalam Borang Permohonan.
  • Anda boleh menggunakan Baucar tersebut untuk membeli telefon pintar Samsung dengan kos maksima tidak melebihi nilai Baucar yang diterima. Anda boleh memilih untuk membeli telefon pintar yang nilainya kurang atau lebih daripada nilai Baucar, namun jika pembelian anda melebihi nilai Baucar, anda akan diminta membayar baki jumlah tertunggak melalui kad debit / kredit di laman web.

Sila ambil maklum bahawa:

  • Baucar adalah tidak sah selepas tarikh luput yang dinyatakan melalui SMS atau mesej dalam Aplikasi.
  • Baucar ini hanya sah untuk pertukaran dengan telefon pintar di laman web Rakan-Kongsi https://myviporder.com/grab/ dan tidak boleh ditukar kepada wang tunai.
  • Baucar tidak sah untuk pembelian fizikal di kedai Rakan Kongsi.

* Nilai Baucar adalah berbeza mengikut kelayakan individu Rakan Pemandu dan akan diberitahu selepas permohonan diluluskan.

3. PEMILIHAN PRODUK
  • Dengan menyertai Tawaran ini, anda juga mengakui bahawa anda telah membaca dan memahami dan bersetuju dengan terma dan syarat yang dikeluarkan oleh Rakan-Kongsi yang mungkin dipinda dari semasa ke semasa tanpa notis kepada anda. Setiap Rakan Pemandu dibenarkan untuk membeli satu (1) unit produk pada satu masa. Semua gambar yang dipaparkan adalah untuk tujuan ilustrasi sahaja dan mungkin berbeza dengan produk sebenar. Semua produk dan warna bergantung kepada ketersediaan stok. Tawaran adalah terbuka kepada pemohon terawal dan sementara stok masih ada sahaja. Kod Baucar perlu dimasukkan untuk membolehkan Pembayaran Balik Harian (seperti yang dinyatakan dibawah) untuk Tawaran ini. J Pesanan telefon pintar akan disemak dan diluluskan oleh Syarikat dan Rakan-Kongsi akan meneruskan pesanan berdasarkan persetujuan daripada Syarikat.
4. TANGGUNGJAWAB RAKAN PEMANDU
  • Dengan menyertai dan menerima Tawaran ini, anda bersetuju bahawa anda akan bertanggungjawab terhadap Pembayaran Balik Harian (seperti yang dinyatakan di bawah) untuk Tawaran ini. Anda dengan ini mengakui penerimaan notis penyerahan hak bahawa hutang daripada pembelian telefon pintar anda akan diserahkan oleh Rakan Kongsi kepada Syarikat.
  • Untuk mengelakkan keraguan, Rakan-Kongsi akan bertanggungjawab sepenuhnya untuk melaksanakan semua kewajipan mereka di bawah invois penjualan dan di bawah undang-undang perlindungan penggunadan Syarikat adalah sama sekali tidak bertanggungjawab sekiranya Rakan-Kongsi gagal untuk melaksanakan kewajipan mereka.
5. POTONGAN HARIAN
  • Berdasarkan jumlah pembelian telefon pintar, anda perlu membayar balik dalam 182 jumlah ansuran yang sama pada setiap hari (“Pembayaran Balik Harian”).
  • Pembayaran Balik Harian akan dibuat melalui potongan dari dompet tunai dan/atau kredit Rakan Pemandu pada setiap hari untuk 182 hari berturut-turut dari tarikh yang diberitahu oleh Syarikat kepada anda (SMS atau mesej dalam Aplikasi) sehingga pembayaran penuh untuk jumlah invois berjaya dilakukan. Sekiranya jumlah dalam dompet tunai dan/atau kredit tidak mencukupi, percubaan pemotongan berganda akan dilakukan setiap hari sehingga jumlah tertunggak diterima.

  • Semua pembayaran dibuat dalam Ringgit Malaysia (RM). Tiada caj atau bayaran tambahan dikenakan oleh Syarikat.
6. PENGHANTARAN
  • Rakan-Kongsi akan mengedarkan telefon pintar yang sudah dibeli kepada pelanggan melalui perkhidmatan penghantaran kurier ke alamat anda. Telefon pintarakan dihantar 7 hari bekerja setelah pesanan diluluskan oleh Syarikat. Alamat penghantaran mestilah di dalam Malaysia. Sila ambil maklum bahawa terdapat caj penghantaran tetap berjumlah RM20 akan dikenakan yang TIDAK termasuk dalam nilai Baucar. Ini juga terpakai walaupun nilai telefon pintar yang dibeli kurang dari nilai Baucar. Bayaran penghantaran RM20 akan dikenakan secara berasingan ke kad debit / kredit anda.

7. POLISI PEMBATALAN
  • Anda tidak dibenarkan untuk membatal, mencabut atau menarik balik penyertaan anda dalam Tawaran ini setelah anda menerima pemberitahuan dari kami bahawa permohonan anda berjaya.
8. JAMINAN
  • Semua produk Samsung adalah 100% asli dan original dari Samsung.
  • Semua produk Samsung yang baru adalah dilengkapi dengan jaminan terhad satu (1) tahun untuk kerosakan dan penggantian alatan.
  • Sila kunjungi Pusat Servis Samsung yang terpilih untuk apa-apa kerosakan.
  • Harap maklum bahawa aksesori di bawah Pembelian dengan Pembelian (PWP) dan hadiah percuma adalah produk generik dan tidak termasuk di dalam jaminan.
9. DATA PERIBADI
  • Dengan menyertai Tawaran ini, anda mengakui bahawa maklumat yang anda berikan kepada Syarikat mungkin termasuk data peribadi anda dan anda memberikan kebenaran kepada Syarikat, dan Grab untuk memproses data peribadi anda bersesuaian dengan polisi peribadi Grab dan undang-undang perlindungan data yang berkenaan. Segala data peribadi yang dihantar ke Rakan-Kongsi melalui https://myviporder.com/grab akan akan diatur oleh dasar privasi yang terdapat di laman web tersebut: http://myviporder.com/grab/privacy-policy/.
10. PELBAGAI
  • Syarat Penggunaan Rakan Pemandu Grab juga diguna pakai untuk Terma dan Syarat ini.
  • Syarikat berhak untuk meminda mana-mana Terma dan Syarat ini pada bila-bila masa. Pindaan tersebut akan berkuatkuasa setelah dimaklumkan kepada anda.
  • Syarikat tidak bertanggungjawab atas sebarang tuntutan oleh anda atau pihak ketiga atau kerugian dalam apa jua bentuk, termasuk tetapi tidak terhad kepada kerugian pendapatan, punitif, tidak langsung, khas, sampingan atau akibat atau untuk kerosakan lain yang disebabkan oleh atau berkaitan dengan Tawaran ini.
  • Syarikat tidak bertanggungjawab atas kehilangan atau kerosakan harta benda atau kecederaan peribadi atau kehilangan nyawa disebabkan oleh atau berkaitan dengan Tawaran ini.
  • Syarikat berhak, mengikut budi bicara mutlaknya, untuk menggunakan nama, gambar, rakaman video atau suara dan catatan Rakan Pemandu untuk tujuan publisiti, periklanan, perdagangan atau untuk Program Eksklusif Grab di mana-mana media, tanpa perlu mendapatkan persetujuan atau membuat apa-apa pembayaran kepada Rakan Pemandu.
  • Anda mengakui dan bersetuju bahawa Syarikat berhak untuk membatalkan mana-mana penyertaan atau menghentikan perkhidmatan di bawah Tawaran ini jika Rakan Pemandu melanggar mana-mana Terma dan Syarat ini yang tidak diperbaiki, atau jika boleh diperbaiki, dibaiki dalam masa 3 hari dari tarikh penerimaan notis dari Syarikat. Walau apa perkara di atas, Syarikat berhak untuk membatalkan penyertaan Rakan Pemandu dalam Tawaran ini, dengan notis kepada Rakan Pemandu, atas budi bicara mutlak tanpa memberikan apa-apa alasan.
  • Keseluruhan baki tertunggak anda di bawah Terma dan Syarat ini akan jatuh tempo dan perlu dibayar sepenuhnya kepada Syarikat sekiranya perkhidmatan dibatalkan oleh Syarikat.
